Risk of Loss All items purchased from Books4u.in are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. Damages Books4u.in can at its sole discretion immediately terminate any customer services and account which it believes is placing false orders on the website using cash on delivery payment mode and refuses to take deliveries after such order. This also includes customer accounts, which after giving orders and receiving the goods, passes instructions to the credit card companies to refuse for the payment in said transaction. In addition, because damages are often difficult to quantify, if actual damages cannot be reasonably calculated then you agree to pay Books4u.in liquidated damages of RS 1000 in India and $100 (US Currency) if the delivery was made outside India for each piece of merchandise ordered in the subject transaction through your customer account, otherwise you agree to pay Books4u.in actual damages, to the extent such actual damages can be reasonably calculated. It is the express will of the parties that this agreement and all related documents have been drawn up in English.
